A DRUNK and disorderly man has been banned from driving for more than three years after refusing to provide a breath sample.
Kyle Shepherd appeared before West Cumbria Courthouse on August 26, having pleaded guilty on July 22 to failing to provide a specimen for analysis and being drunk and disorderly.
The offences took place on June 21 in Whitehaven.
The court heard that 24-year-old Shepherd was suspected of having attempted to drive a vehicle and was asked to provide a specimen of breath for analysis.
He failed to comply without reasonable excuse, in breach of the Road Traffic Act 1988.
Shepherd also admitted being drunk and disorderly in Brakeside Gardens on the same date.
The court was told he is already subject to alcohol abstinence monitoring equipment as part of a separate community order.
Shepherd, of Miterdale Close, Whitehaven, was handed a new community order and must abstain from alcohol for 80 days as part of the sentence.
He was also disqualified from driving for 42 months, with the ban commencing from July 22, the date of his interim disqualification.
Shepherd was fined £40 for the drunk and disorderly offence and ordered to pay £300 in prosecution costs.
