A 70-year-old man who carried out an indecent act as a woman danced naked in the window of a town centre flat, has been given a community order. 

Kevin Stewart was arrested after he was seen with his trousers round his ankles and his hands in his pants while stood in front of a window in Whitehaven.

There was a female “completely naked” in the window dancing in front of him, Workington Magistrates’ Court heard.

Pamela Fee, prosecuting, said two witnesses, who knew the female in the window, were driving around the one-way system.

A statement made by one of the witnesses said she could see an older man standing in the front of the window and the female was naked.

She said she could clearly see the male with his trousers around his ankles and he was wearing stripy underpants. He was described as performing an indecent sexual act.

The witnesses contacted police and an officer arrived on the scene. He could see the defendant with his nose up against the glass and he appeared to be performing a sex act.

Stewart was arrested and taken to the police station.

A statement read out to the court from one of the witnesses said: “I found it funny at first but that turned to disgust.

“I was worried about the female. I was worried he may have been taking advantage of her.”

The defendant was interviewed by police and he said he had been walking home when he saw a naked woman.

He said he was shocked by her behaviour and the next thing he knew he was talking to police. He denied he had been performing a sex act.

Stewart said he had “problems in the trousers department” and hadn’t been diagnosed with erectile dysfunction but suffers from it.

He couldn’t give an account of how the witnesses could describe his underpants. He also commented that he needed to get a good divorce lawyer.

Stewart, who was not legally represented in court, said he had nothing to add, other than he was “deeply sorry”.

The defendant, of Duke Street, Whitehaven, pleaded guilty to an act of outraging public decency at a hearing on November 22.

Passing sentence on Monday, Jennie Wilkinson, chair of the magistrates, said: “This was an unpleasant occurrence. I am sure you have learned your lesson, loud and clear.”

Stewart was given a six-month community order, with 15 rehabilitation activity requirement days. He was fined £80 and ordered to pay £85 costs and a £95 victim surcharge.
