A woman who says she was raped by two men in Whitehaven heard one of the alleged attackers use the words “biggest mistake” as they walked away, a jury was told.

Terry Parry – the man said to have uttered the phrase – also allegedly remarked “what did I tell you?” when his co-accused Stuart Milne was arrested by police.

Parry and Milne, both 37, are on trial at Carlisle Crown Court having each pleaded not guilty to a charge of rape. Milne also denies another alleged sexual offence which arises from the same incident during the early hours of June 29 last year.

On day two of the trial on Tuesday, jurors were shown a video interview that the woman gave to police after reporting she had been attacked at a walled park in the middle of Whitehaven.

She told how she met both Milne and Parry for the first time earlier that evening in the town centre. The woman was bought several drinks before the group went into the street at around 1.30am.

“He (Milne) pulled me around a corner and started kissing my neck and biting my ears,” she said in the interview. Milne was then alleged to have led her into the walled park.

“Within a minute I was on the floor and my pants were down, and I could feel him on top of me,” she continued.

“My phone was in my hand and I just started pressing 999. I don’t know whether he heard someone talking on the phone.

“He kept knocking my phone off, pressing the ‘end’ button on all my calls. I kept getting a call from an unknown number.

“I just kept pressing the ‘answer’ button, hoping someone would hear what was going on.”

It is alleged that she was then raped by Parry before he and Milne then left the area.

In his opening of the case to a jury of seven women and five men, prosecutor Andrew Ford alleged: “She picked Parry up saying ‘biggest mistake’.”

After the woman raised the alarm, police swiftly found the two men.

“Milne was arrested by a police officer, who heard Parry saying ‘what did I tell you?’,” Mr Ford added.

Both Milne and Parry, who live at separate addresses on Bow Fell Road, Whitehaven, were interviewed by police.

They denied committing any crimes. Both men insisted their respective contact with the woman in the park was consensual.
