Prosecutors have accused a man of playing “pick and mix” with his community order.

Christopher McGraffin, 20, appeared at Carlisle Crown Court yesterday charged with two counts of breaching a community order.

McGraffin, who lived in Penrith but has recently moved back to Blackpool to live with his parents, was given the order in September for affray and destroying or damaging property.

Since then he has completed just 31 hours and 45 minutes of the 150-hour sentence. He appeared in court in November for breaching the order, and was given an additional 10 hours on the sentence.

Tim Evans, prosecuting, told the court that McGraffin had breached the order again on January 3 and March 9 this year.

“My submission is that there is absolutely no reason why this defendant should not complete these hours,” Mr Evans said.

“This is a court order. It’s not like pick and mix.”

Elizabeth Muir, defending, admitted there was no valid reason McGraffin could not complete the hours, but said that as he is now living with his parents this would be a better influence on him.

Recorder Harry Narayan added 10 hours on to the existing order for each breach, bringing the total number of hours to 180.

He was also ordered to pay £100 costs.
